This website www.serveafghanistan.org is owned and managed by Serve Afghanistan (Hereafter referred to as ‘Serve’). We are a charity registered in the United Kingdom (number 1105086). Our company number is 4759091, our NGO Number registered with the Afghan Ministry of Economy is 50 and our registered office is c/o UHY Hacker Young, 6 Broadfield Court, Broadfield Way, Sheffield, S8 0XF, UK.

For the purposes of these terms and conditions, ‘us’, ‘we’ and ‘our’ refer to Serve.

USE

This website is made available for your private or personal use, or otherwise in pursuit of Serve’s charitable objects, subject to our Terms.

You agree to only use the website for lawful purposes and in a manner which does not infringe the rights or restrict or inhibit the use or enjoyment of the site by any third party. Users of our interactive features should also refer to our Terms of Use and Participants’ Rules below.

You must not knowingly transmit any data, send or upload any material which contains viruses or any other harmful programs which could harm computer software or hardware.

Although we will use reasonable efforts to keep the information on our website up to date and correct we cannot guarantee it will be complete and accurate and we cannot take responsibility for any inaccuracies, omissions or errors attributable to the author of such materials.

When we make available guidelines or instructions for carrying out activities you must not rely on them as stating best, recommended or safe practice. Before you engage in such an activity you should consult an appropriately qualified independent adviser. In any event, any decision made by users of our website, on the basis of information supplied on the site, is the responsibility of the user. We do not accept liability (as far as permitted by law) for any loss arising from any use or reliance on information or links included in this website.

Except as specifically set out in these Terms and Conditions, to the fullest extent permissible by law, neither Serve nor any of its affiliates, directors, employees or other representatives will be liable (whether under contract, tort or statute) for any of the following losses or damage (whether or not such losses were foreseeable):

  • Loss of revenue
  • Loss of business or opportunity
  • Loss of goodwill; or
  • Any indirect, consequential, special or exemplary damages

Arising from the use of the website, the inability to use the website, the results of the use of the website, any website linked to it or any material contained in the website and for the avoidance of doubt the losses listed immediately above are intended to be severable.

The foregoing does not affect Serve’s liability for death or personal injury arising from Serve’s negligence or Serve’s liability for fraudulent misrepresentation, nor any other liability which cannot be excluded or limited under applicable law.

Serve is not responsible for ensuring the availability of this website or the timeliness or otherwise of any content or information being made available to you and we reserve the right to make changes to the site at any time without notice.

Serve also takes no responsibility for the content of external internet sites. Other websites that we link to are owned and operated by third parties and Serve has no control over them. The fact that we include links to other websites does not mean that we approve of or endorse any other third party website or the content of that website. We accept no liability for any statements, information, products or services that are published on or are accessible through any websites owners or operated by third parties.  

Any communication or material that you transmit to, or post on, any public area of the site including any data, questions, comments, suggestions or the like, is and will be treated as non-confidential and non-proprietary information.  

We reserve the right to terminate your access to the website or any part of it or to withdraw any of our services at any time without notice for any reason. Occasionally we may restrict access to some parts or the whole of our website to users who have registered with us.

As we also reserve the right to replace or modify these Terms and Conditions and any linked policies at any time without notice and we therefore advise that you check this page each time you use the site. All copyright, design rights and database rights and other intellectual property rights in the online services remain the sole property of Serve or its licensors.

Banners are the property of the third party provider of the banners.

We’d love you to be able to show your support for our work by using our logo on materials you produce for that purpose, so if you need a Serve logo for any of the following uses, you can download an appropriate version from the website:

  • You are working in partnership with Serve and want to use the logo on resources / materials to promote this
  • You need a logo for an event raising money for Serve
  • You want to use the logo to promote and raise awareness of Serve’s work
  • You would like to use the logo in a school project or presentation

TERMS OF USE AND PARTICIPANT'S RULES

Participating in blogs, debates, Q&As and polls on the Serve site:

We welcome your participation in any interactive feature on our site, including your posting comments to our blogs, submitting questions for a featured Q&A, adding your opinion to one of our debates, taking part in one of our polls or adding to our prayer wall. We want to hear your views in response to our debates and blogs and we will listen to your comments.

For the purpose of the Terms of Use, ‘post’ can refer to any interactive section of the website.

Due to the sensitivity of some of the locations we work in and the issues that we address, we may have to moderate all comments submitted. This is a precaution to ensure that we do not jeopardise our staff security. For this reason, there may be a delay between the submission of your comment and it appearing on the site. We will do our best to include your post as quickly as possible. We reserve the right to withhold any post, without further comment or notice to you.

We reserve the right to remove the access of any individual who has abused Serve’s web services, breached the Terms and Conditions, Terms of Use and/or persistently submitted inappropriate material.  

Be aware that in exceptional circumstances Serve could be legally obliged to reveal your registration information and/or IP address to the authorities.

In order to participate in any interactive feature on this site, we ask that you observe the Terms of Use, including the following Participants' Rules. Site users are also governed by our website Terms and Conditions.

PARTICIPANTS' RULES.

  • Please be considerate of other participants’ access to and enjoyment of the post and avoid using slang or shorthand.
  • People of all ages and backgrounds visit www.serveafghanistan.org. Please do not use profanities or other words (including shorthand or substitutions) that might offend others.
  • Do not post any material that is defamatory, obscene, indecent, lewd, pornographic, violent, abusive, insulting, threatening, harassing, discriminatory, blasphemous or otherwise unlawful or illegal. A defamatory comment is one that is capable of damaging the reputation of a person or organisation.
  • Do not post anything that is or may be contempt of court (anything that risks prejudicing ongoing or forthcoming court proceedings) and avoid breaking any known court injunction.
  • Do not incite people to commit any crime, including incitement of racial hatred.
  • Do not post personal attacks on other participants.
  • Do not impersonate other participants or public figures.
  • Do not create multiple user identities for the purpose of abusing the services of this site or the experience of other users.
  • No personal information please. It is not acceptable to publicise your or anyone else's contact details. This is for your own safety and that of everyone who uses this service.
  • Please do not submit questions or comments of a personal nature to our bloggers, debaters or interviewees. We will consider these off topic and will not include them.
  • No spamming or flooding.
  • All posts should relate directly to the discussion topic.
  • We reserve the right to terminate lengthy and involved discussions between a handful of people if we feel that this is having a negative impact on fellow participants' experience on the site.
  • We reserve the right to post a representative comment or question if we have received a number of a similar nature.
  • We reserve the right to edit comments for length.
  • Occasionally, when discussions have become irrelevant to the post in question, we will close comments on that post, and we may delete comments already posted if they are unrelated to the topic, to reduce the size of the page for other users.
  • Do not submit anything that may infringe another's rights, including intellectual property rights.
  • All submissions should be your own original work. Do not post content you have copied from someone else.   • We will hold your personal data on our systems for as long as this service is provided, or until you request that we remove your details.

SUSPENSION AND TERMINATION

We will determine, in our discretion, whether there has been a breach of this acceptable use policy through your use of our site. When a breach of this policy has occurred, we may take such action as we deem appropriate.

Failure to comply with this acceptable use policy constitutes a material breach of the terms of use upon which you are permitted to use our site, and may result in our taking all or any of the following actions:

  • Immediate, temporary or permanent withdrawal of your right to use our site.
